In case you have a criminal record and want to enter the United States with a USA tourist visa or ESTA visa waiver, you may encounter some difficulties when applying. However, this does not mean that it is impossible.
What matters when it comes to obtaining a visa or waiver is the type of crime committed and whether or not there was a conviction, i.e., the details of the criminal history. Murderers and rapists will not be treated the same as those who have committed minor offenses such as driving under the influence of alcohol.
For example, some minor offenses for which it is possible to travel to the United States and thus apply for and complete the ESTA form without any problem are: Drunk driving, assault or trespassing.
However, having committed these offenses repeatedly WILL be sufficient grounds for refusal of entry. Also drug convictions are a crime for which you will most likely be refused entry or crimes such as rape, kidnapping, manslaughter, murder or forgery.

As a general rule, the annotation of the criminal record has a temporary character, that is, it can be cancelled after a certain period of time and in conjunction with other requirements. The time that must elapse for the record to be expunged generally depends on the type of offense, whether it is minor or serious, for example.
The second feature is that only those facts that are declared in a final court judgment issued in the field of criminal jurisdiction may be entered in the criminal record. This means that it is not possible to register convictions handed down in other jurisdictional areas, even if they are of a punitive nature, such as administrative sanctions or pecuniary sentences handed down in the civil sphere.
Can you travel by air with a criminal record?
Each country has the sovereign right to decide who may enter its territory and who may not. A visa is an authorization that enables the visa holder to proceed to the Republic and report to an Immigration Officer at the port of entry to the country for the purpose of assessing his/her ability to meet the (entry) requirements as stipulated in the Immigration Act 2002 (Act No 13 of 2002) as amended.
